Outdated State Public Health Laws Jeopardise Nigeria’s Outbreak Preparedness, NCDC Warns

In an urgent appraisal of Nigeria's biosecurity posture, the Nigeria Centre for Disease Control and Prevention (NCDC) has warned that antiquated public health statutes across various states are crippling the federation's capacity to effectively preempt, contain, and control infectious disease outbreaks. Many sub-national legal frameworks currently governing epidemic response remain rooted in colonial-era public health ordinances and decades-old legislation that lack the modern mechanisms required for swift biological surveillance, contact tracing, and emergency funding.

Public health officials emphasise that while federal protocols under the NCDC have undergone substantial modernisation since the COVID-19 pandemic, sub-national implementation frequently collides with statutory vacuums. In several states, the legal authority of health commissioners to enforce quarantines, mandate rapid lab sample submissions, deploy mobile isolation facilities, or sanction non-compliant institutions remains ambiguously defined or outright obsolete, leaving epidemiologists legally constrained during critical golden hours of an outbreak.

The systemic risk posed by these statutory gaps has become increasingly evident amid recurrent surges of endemic and emerging diseases across the country, including Lassa fever, cholera, diphtheria, and mpox. When local authorities encounter legal ambiguities in declaring health emergencies or enforcing disease containment directives, response timelines are stretched dangerously thin, directly correlating with elevated case fatality ratios in affected rural and semi-urban communities.
